Terms of Service

Who we are

Carros506 is a verification and transaction-coordination platform for Costa Rica motor-vehicle and property transactions, operated by Bowery Holdings LLC, a United States limited liability company (“the Operator,” “we,” “us”). The Operator is a U.S. company and has no Costa Rican subsidiary. These terms are a binding agreement between you and the Operator.

What Carros506 is

We check identifiers you submit (a plate, finca, or coordinate) against official Costa Rican registries and return a screening verdict, and — where you request it — we help coordinate a secured closing (escrow plus a Costa Rican notary). We are a coordinator and information service. We are not a law firm, a notary, a title insurer, a broker-dealer, a money transmitter, or an escrow agent, and we do not provide legal, tax, or investment advice.

Screening, not a legal opinion

Our verdicts are a screening tool based on registry data available at a point in time — not a certified title opinion, legal advice, or a guarantee. A registry reference can differ from the definitive record. Before you buy, confirm ownership, liens, boundaries, water, and maritime-zone status with a licensed Costa Rican attorney or notary. You are responsible for your own due diligence.

Escrow & closings

Funds in a safe close are held by Escrow.com, a US-licensed escrow service, and disbursed under their terms, which you accept separately when you fund a transaction. Carros506 acts only as a coordinator and never takes custody of your money. Funds are released to the seller only after a notary completes a clean transfer and the escrow conditions are met. Escrow.com performs its own identity verification of the parties.

Costa Rican notaries are independent

Any transfer is executed and registered by a Costa Rican notario público, whose function is a delegated public function under the Código Notarial (Ley N° 7764). Each notary is an independent professional — not our employee, agent, or partner — exercises independent professional judgment and personal responsibility (fe pública) over the estudio, escritura, and inscription, and charges their own fee, subject to the legal arancel. We do not share in or take any part of the notary’s fee, and we are not liable for a notary’s acts, omissions, delays, or charges.

Fees & refunds

• Our coordination fee (currently US$400) is disclosed before you pay and, unless stated otherwise, paid by the buyer.
• The notary’s fee and government stamps (timbres) are separate and charged by the notary.
• If a transaction does not close, escrowed funds are handled under Escrow.com’s terms. Our coordination fee is refundable until a notary is assigned to your transaction, and non-refundable once the assigned notary begins the estudio registral.

Text messaging

By providing your phone number and opting in, you consent to receive SMS and WhatsApp messages from Carros506 about your inquiry, verification, or transaction (specialist replies, lead and status updates, appointment and closing coordination). Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help at any time. We do not share your mobile number or messaging consent with third parties for their marketing — see our Privacy Policy.

Acceptable use

• Use the service only for lawful transactions you are a party to.
• Provide accurate information; do not impersonate others.
• Do not misuse, scrape, reverse-engineer, overload, or disrupt the service, or use it to compile or resell registry or personal data.

Intellectual property

The service, its content, verdict presentation, and software are owned by the Operator or its licensors. We grant you a limited, revocable, non-transferable license to use the service for its intended purpose. Registry source data remains subject to its originating authority’s terms.

Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, the Operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on a screening verdict, from a transaction, or from the acts of third parties (including notaries, escrow providers, or registry sources). Our aggregate liability for any claim is limited to the coordination fees you paid us for the transaction giving rise to the claim. Nothing limits liability that cannot be limited by law.

Indemnification

You will indemnify and hold harmless the Operator from claims, losses, and expenses (including reasonable legal fees) arising from your use of the service, your breach of these terms, or your violation of any law or third-party right.

Suspension & termination

We may suspend or terminate access for breach of these terms or suspected unlawful use. Provisions that by their nature should survive — fees owed, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

Governing law & disputes

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. For transactions physically executed in Costa Rica, the mandatory provisions of Costa Rican consumer law (Ley 7472) and the Código Notarial apply and are not waived. Any dispute will be resolved by binding individual arbitration before the American Arbitration Association under its Consumer Arbitration Rules, seated in New York, with a class-action waiver; you and the Operator waive jury trial to the extent permitted. Either party may still bring an individual claim in small-claims court.

Consumer rights (Costa Rica)

Nothing in these terms limits the non-waivable rights of consumers under Ley N° 7472 and its e-commerce regulations, including the rights to clear pre-contract information, truthful pricing, and the remedies administered by the Comisión Nacional del Consumidor.
